Correct me if I'm wrong, but doesn't the empeg software rely on the scratch partition to be at least 16MB in size?

But, swap is only enabled when the player is synchronizing and AFAIK the player just calls 'swapon /swapfile' so all you would have to do is adjust that symlink to point to the real HD.
