I don't know much about US law, but surely by this point it is no longer self defence, so isn't drawing the gun on them once they are running away getting onto dodgy legal ground ?

I believe in America (in some states anyway) you can also defend your goods with firearms as well as your person.

I still haven't decided for myself wether I think this is a good thing or not.
