Besides licensing, I would worry more about this statement:

Unlikely to work with the empeg unless it's backwards compat like MP3 Pro and even that was a bit naff. It'd play but you'd end up with something 1/2 the bitrate since the new Pro bit would just be ignored. Even if we some how managed to get a licensed codec in, the empeg is only stereo

The Ogg Vorbis spec can already do more than two channels anyway. Of course, I don't think that anything actually implements that feature.

No. The empeg's output hardware is ordinary stereo, using a Philips DSP chip that's meant for ordinary stereo car CD players. There is no way on the empeg to have more than two channels of output.

So no matter what tricks you do in software to decode multi-channel information, there is nothing you can do to make more than two channels play out of the empeg's outputs.

Besides that, I believe it needs to be configured differently to output surround. Since all settings are done with hardware, it would not be easy to change.
