Brilliant. Hope this little trick of his nets a whole lot of high-profile prosecutions.

Web harvesting is not the only way to get spammable addresses, but for those spammers that practice that technique, this is a great way to nail them.

I'd rather have 1,000 times as much spam than see this sort of "non-clickthrough" licence held enforceable. But fortunately it sounds as if Project Honeypot can succeed in proving illegal activity without the licensing bit.

I agree. I like their motives, but "implied consent" is kinda weird.

Well, the only part of that that's odd is the "don't use this address for any reason" part. You IP address gets recorded at virtually all web servers anyway without them even telling you.

And phone companies send me checks all the time where if I cash them I get my service transferred.

I don't know. I understand your points, but the user of the email address is doing something active with the data on that page. I don't see how that's much different than saying "here's some source code, but you can't use it unless you also release any changes you make".

True. I guess that point is made or implied mid-way through and I kinda forgot it by the time I got through it! Just visiting a site should legally bind you to anything, but these spammers are doing more than just surfing and collecting info - they are using that info or passing it on,
